California law requires, with certain exceptions, that non-exempt employees be provided with a meal period of not less than thirty (30) minutes for a work period of more than five (5) hours. The employee must be relieved of all duties during this meal period. Employers who violate this law must pay the employee one (1) hour of pay at the employee's regular rate of pay for each workday that the meal period is not provided. There are exceptions to this law such as a written agreement between the employer and employee that must be executed before waiving this legal right.
California law also requires, with certain exceptions, that non-exempt employees be provided with a rest period of not less than ten (10) minutes per four (4) hours of work. The employee must be relieved of all duties during this rest period. The rest period shall be counted as hours worked for which there shall be no deduction from wages. Employers who violate this law must pay the employee one (1) hour of pay at the employee's regular rate of pay for each workday that the rest period is not provided.
